This Terms of Service Agreement (the “Agreement”) governs your use of fibercrafty.com, any other internet domain names owned or operated by FiberCrafty, LLC, and any mobile device applications provided by FiberCrafty (the “Site”) and any services made available to You by FiberCrafty, LLC (hereinafter, “FiberCrafty”, “We”, “Us” or “Our”) on or through the Site (the “Services”). For purposes of this Agreement, “You” means the person using the Site or the Services or, if You are using the Site or Services on behalf of Your company (or another entity), then “You” means Your company (or such other entity), its officers, members, agents, successors and assigns.
By using the Site, the Services, or FiberCrafty for shopping or selling items, you are consenting to the following terms and policies.
FiberCrafty will only use the information shared with us in relation to your activities on FiberCrafty. We will not sell or share your data or information with any other 3rd party companies, entities, or individuals unaffiliated with FiberCrafty. We will share your contact information with FiberCrafty shops that you purchase from so that they may fulfill orders and provide customer service to you.
We know that shopping online or opening an online shop means personal information is exchanged. We have used high level standards in the payment processing industry to help protect the safety of your data.
Don’t maliciously try to harm FiberCrafty or any of the shops or accounts listed on our site. This includes linking or referencing to other marketplace platforms where similar products might be sold.
We reserve the right to decline any transactions that appear fraudulent or illegal at our sole discretion.
Shoppers and all account holders
FiberCrafty provides a service for shop owners to sell items and for shoppers to buy items. Just like a shopping mall that houses stores, FiberCrafty is not responsible for and does not warrant the quality of items, or the fulfillment of orders. Any issues need to be resolved between the shop owner and the shopper. FiberCrafty is absolved of any disputes and the responsibility to resolve any disputes that may arise.
We can only provide customer service and support if you provide us with accurate and truthful information. Do not falsify your information in any manner. Do not infringe on others by using their copyrighted information or other intellectual property. We cannot do business together under those circumstances.
Are you 13? Great. If not, we are sorry, but you will have to wait until you turn 13 to use FiberCrafty.
Your account is yours and you are the one responsible for it. Keep your password safe and be aware that if you let someone use your account, you are still the one responsible for it.
No vulgarity on the site. It is your right to choose what words you use, but it is our right to limit offensive language on FiberCrafty. Just don’t do it or we might send you some soap to wash out your mouth.
You can close your account and discontinue use of FiberCrafty at any time. If you choose to do that, we hope you will share your reasons with us so that we can make improvements in the future. Likewise, we can close your account at any time and for any reason and will not be held accountable for any resulting ramifications on your business.
Be a good neighbor. If you see anything concerning, let us know.
Third parties such as social media sites you might link your FiberCrafty account to are part of the world today. These third party sites have their own terms and conditions and are not covered by the policies of FiberCrafty.
Products sold on FiberCrafty must be intended for the fiber crafting community. Items may range from supplies to t-shirts or household items that are designed for fiber crafters. Items intended for the general public, should be sold on a general marketplace, not FiberCrafty. Items may be commercially made.
Shop Owners may not link to or reference other online sites or marketplace platforms where you may have other products for sale or another shop hosted.
The following items are strictly prohibited from being sold on our site (this is not an exhaustive list):
Meet your obligations. Fulfill orders in a timely manner, communicate with your customers in a timely manner and let us know if you see concerning activity on FiberCrafty. Pay your bills on time.
Don’t do illegal stuff. Don’t sell stolen items. Don’t sell anything illegal. Don’t break any laws. You are responsible for your business including any transactions on FiberCrafty. This includes obtaining required business licenses and collecting and remitting any applicable taxes, including sales tax.
Collecting Sales and Use tax for your business is your responsibility. Make sure you know what your obligations are for your business. We have provided a way for you to upload a variety of tax rates to help with your collection but you are responsible for ensuring that you are collecting and paying to your local government.
You are granting FiberCrafty permission to use and repost your images and shop information. Your product and shop images are yours, but we will use them in marketing and social media. If we alter your image, it may only be for sizing requirements.
If you choose to open a shop on FiberCrafty, FiberCrafty is not responsible for any success or failure of your business. Shop Owners should educate themselves on successfully running a business. FiberCrafty is strictly a means to help you reach your market.
Fees and Payments
FiberCrafty charges a flat transaction fee for each sales transaction plus shop owners are responsible for covering payment processing fees and shipping fees.
All fees are processed on a nightly basis and allocated to shop owners and FiberCrafty the same day.
Transaction fees are 4% and are calculated on cost of goods exclusive of taxes and shipping. Payment Processing Fees
Payment processing fees are 2.9% plus $.30 per transaction, inclusive of shipping and taxes. Payment processing is handled through Braintree, a Paypal service.
FiberCrafty uses Stamps.com for integrated shipping which allows for discounted shipping rates. The checkout process uses shipping general public shipping fees.
FiberCrafty maintains the right to collect refunds or reimbursement from the shop owner if necessary in the event of refunds, failure to deliver or other failure by shop owner to fulfill obligations. We will attempt communication with the shop owner first.
Federal Tax Reporting
Federal guidelines require that we provide 1099-K forms to shop owners that have $20,000 in revenue and 200 transactions. That’s great news for you if it happens and as that threshold is approached, we will need to get some taxpayer identification information.
By executing any transaction or viewing or using any portion of this Site you agree to hold harmless FiberCrafty, its members, managers, shareholders, officers, directors, parent companies, subsidiaries, employees, agents and assigns including all partners from any claim resulting from violation of this Agreement, accessing this site or engaging in any transaction or interaction stemming from the access of this site.
These terms and any dispute arising there from shall be governed by the laws of North Carolina.
Limitation of Liability
IN NO EVENT WILL FIBERCRAFTY OR ANY RELATED PARTY BE LIABLE TO ANY PERSON OR ENTITY FOR ANY INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, THOSE RESULTING FROM LOST PROFITS, LOST DATA OR BUSINESS INTERRUPTION) ARISING OUT OF THE USE, INABILITY TO USE, OR THE RESULTS OF USE OF THE SITE, ANY WEBSITE LINKED TO THE SITE, OR THE CONTENT OR SERVICES CONTAINED OR ACCESSED THROUGH SUCH SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT OR ANY OTHER LEGAL THEORY AND WHETHER OR NOT FIBERCRAFTY OR A RELATED PARTY IS AWARE OF OR ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN THE EVENT OF ANY PROBLEM WITH THE SITE, THE SERVICES OR THE CONTENT, YOU AGREE THAT YOUR SOLE REMEDY IS TO CEASE USING THE SITE, THE SERVICES OR THE CONTENT.
YOU SPECIFICALLY AGREE THAT FIBERCRAFTY WILL NOT BE LIABLE FOR ANY USERS’ CONTENT OR DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT YOU ASSUME THE FULL RISK OF HARM OR DAMAGE FROM THE FOREGOING.
Some jurisdictions do not allow the limitation of liability for certain damages so the above Limitation of Liability may not apply to You.
We may change the terms of this Agreement as needed. This might happen as we grow, so please stay informed by checking this page periodically. Any significant changes will be communicated to you by email. All currently posted terms override former policies.
